Theoretically, it could be bypassed, that's for sure. But... bypassing this speed limits means using discs for speeds they aren't certified for. This can lead to lower quality burns, or even unreadable discs or failures during the write process.
As the materials on rewritable discs need more time to be written (why is quite a technical story) the speeds are lower (although there are drives that support 32x CDRW speed, there's just a gigantic lack of media).
