I would have to guess that the only legal download sites would be any sites that are paid for. Just like Napster costs money now. Any site or software advocating free downloads of music or movies is highly likely considered illegal. When a fee is charged, a portion of it is sent to the artist, producer...etc...(DA MAN In CHARGE)

I am sure they are. But I do not know how to obtain them nor software that can download them. Usually out of print old movies are not on the general "wanted" list and are not as readily available for download. I can suggest you try WinMX.

I always use mirc to download my audio files. Just go to <URL removed> and do a search on the titel you want...
You have to install mirc but it is very easy and sometimes very fast!!

I'd forgotten about archive.org! For the record, a lot of current singer-songwriter types are releasing live shows there too if that's something you are interested in.

If you want to get out of copyright movies. Old ones like you said, you can usually get them from the library of congress.
I've gotten sheet music for trumpet from them.
I'm not sure if they have movies, but its worth a try.
