Community Talk , Bug Reports & Site Feedback Discuss, Very mixed up about copyright issues in this forum at CDFreaks / MyCE forum; On the one hand you have the biggest collection of posts for bypassing copyrights on CDs. On the other hand, if someone requests help with a keygen or a crack he is told that discussion is not allowed here. I don't get it.

    Your comment does look silly, but seems to have some genuine merit, so I will voice my opinion.

    This forum has NOTHING TO DO with circumventing copyright, and EVERYTHING to do with allowing users who purchased the software to MAKE BACKUPS. In many places other than the USA (and I think even -some- USA laws allow this if you know where to look--in fact, its been already proven that some EULA's violate some state laws, as well as some stores' return policies violating customer laws (example: a game is incompatible with your hardware, A store not allowing you to return it because its "opened"), which is in violating of customer protection laws--if you know the laws, you can get a quick return), you are ENTITLED to make a backup of a CD you purchase, for archival purposes.

    Thus, in these countries, many of the EULA's you see in American-published games are NULL and Invalid, because they violate the laws of the other countries. Heck--did you see what happened in Germany several months ago? A law REQUIRED that Valve *remove* steam / online requirement from the German retail versions of Half-Life 2, because it violates their laws, in order for the game to be sold there. And Valve did it.

    No-CD cracks have NOTHING to do with making 1:1 copies. A 1:1 copy means you make a duplicate of your original CD, WITHOUT needing a no-cd crack. And because it is a 1:1 copy, it does not violate any other country's standard if they allow you to make aforementioned copies. If you need tools to help emulate the protection, then fine--you are still using a direct copy of the original CD. A no-cd crack is related directly to warez, even though they _do_ have their uses, and I use them myself to avoid having to thrash my way through 50-100 packs of game CDs in a bin, looking for the original (and me being disabled with a metal bar through my spine, adds to that). (no one likes having to sort through scores of CD's to find that original stashed somewhere), but that's not the point. This site isn't about no-cd cracks. Its about making backups. If you want forums regarding no-cd stuff, THERE ARE OTHER FORUMS THAT EXIST FOR IT. Readily available. But you are not legally entitled to own a no-cd crack (although you wouldn't get arrested for it--(let someone attempt to sue me for using a no-cd crack, as I am -disabled-...watch it fail miserably), but when countries ALLOW you to make backups---this is what this great forum is all about Making backups of games you own, 1:1.

    Well basically look at it this way - I have small children in my house (and before anyone asks they are mine) - when I buy a new DVD movie or PS2 game - I make a back up and them keep the original safe from getting covered in marmalade or worse. I own the original disc, which I have paid money for, and I feel that it is my right to make a legitimate back up of it. This is an area of the law that has never been tested in most counties and would probably fall under fair use.

    If this forum openly discussed things like keygens and cracks, it would more than likely be shutdown very, very quickly. This is againts the law in most countries and for example in the UK infringing copyright is a criminal act.

    Hehe, I probably should have explained it in a less wordy way.

    Rather obvious, now that I am thinking about it.

    1) Making a 1:1 true image of a protected CD/using emulation to correct any protection differences between master and duplicate; is NOT illegal, as no code on the original CD is altered. (and you are entitled to make backups). The protection is not removed, so you're good to go.

    2) Using a no cd crack IS illegal, because the code is altered and the protection is removed. Its removing the protection that is the gotcha.

    Your post is based on a well-known and widely spread practice of oversimplifying an issue, thus neglegting its complexity.

    To make it clear for you and others from here to eternity:

    1. Laws concerning copying of any data differ in the world. The CDF Community consists of members from different countries.
    2. Legal or illegal actions in this field are judged by many options (country of origin, country of stay, origin of the data copied, etc.)
    3. CDF has no posts on bypassing copyrights as it is impossible, i.e. "copyrights" is a legal term and not a protection.
    4. CDF's main rules can be easily read, if need may rise in cases, showing signs of ambivalent perception.
